The Office of Information and Data Protection Commissioner and the European Union have launched an initiative relating to the modernisation of the regulatory framework in the field of personal data protection by medium of the Twinning Project “Institution-Building for Alignment with Union Acquis on the Protection of Personal Data”. This project shall provide for alignment of the Albanian legal framework with the General Data Protection Regulation 2016/679 (GDPR) and the Law Enforcement Directive 2016/680.

The kick-off ceremony held online gathered distinguished participants, including Mr. Pasquale Stanzione, President of the Italian Data Protection Authority, Mr. Zef Mazi, Chief Negotiator for EU Membership Negotiations, Ms. Adea Pirdeni, Deputy Minister of Justice, Mr. Mario Mariani, Head of Cooperation, EU Delegation in Albania, Ms. Jutta Gutzkow, Head of the Council of Europe Office, Mr. Alberto Petrangeli, deputy Ambassador of Italy and Ms. Renate Seib, deputy Ambassador of Austria.

Commissioner Dervishi stressed in his note that “today we set yet another quality milestone, with the Twinning Project laying stronger foundations towards ensuring alignment with the GDPR and the approval in principle of the accession of Albania to the Convention 108+ of the Council of Europe. Democracy shines brighter with the right to protection of personal data and human dignity.”

The new legal framework in the data protection field marks an important contribution in the path of European integration of Albania. This twinning project enables Albanian citizens to benefit from the modernisation of the data protection legislation and alignment with EU standards.

Under the new legislation, individuals will have greater control over the processing of their personal data. The main innovations of the new law will include contemporary concepts, which go hand in hand with the development of technology such as the new means of giving consent, the right to be forgotten, and other fairly new concepts such as data portability, privacy by default and by design, or stronger sanctions in cases of violation of this law. Alignment of the national regulatory framework with the EU GDPR and the Law Enforcement Directive shall also strengthen the role of the Commissioner’s Office in order to better address issues affecting privacy and data protection.

Participants praised the coordination and the effective cooperation provided so far by all the partners to the project and reaffirmed that the project will be implemented with quality and within the deadlines. The main output of the project is the development of a newly consolidated law on personal data protection in Albania, whereas its further implementing steps were announced.

The twinning project is being implemented by the Italian Data Protection Authority (Garante per la Protezione dei Dati Personali), supported by CSI Piemonte, Italy and the “Ludwig Boltzmann” of Fundamental Human Rights and Freedoms, Austria.
